Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Total Success Program (“TSP,” “the Program,” “we,” “us,” or “our”) membership platform. By registering for a membership, you agree to be bound by these Terms.
1. Membership and Access
By purchasing a TSP membership, you are granted access to the Program’s online content, including but not limited to video lessons, resources, and community features. Your membership is personal to you and may not be shared, transferred, or assigned to any other individual.
2. Payment Terms
Signup Fee: A one-time, non-refundable signup fee of $49.00 is charged at the time of registration.
Monthly Subscription: A recurring fee of $9.00 per month is automatically charged to your payment method on file.
Auto-Renewal: Your membership will automatically renew each month until you cancel. You are responsible for canceling your membership through your account page if you no longer wish to be charged.
Payment Processing: All payments are processed securely through Stripe. By subscribing, you also agree to Stripe’s terms of service.
3. Cancellation and Refunds
You may cancel your membership at any time through your account page. Cancellation will take effect at the end of your current billing period.
There are no refunds for partial months. Once a monthly payment has been processed, it is non-refundable. The one-time signup fee is non-refundable under any circumstances.
We reserve the right to cancel or suspend your membership at our sole discretion for violation of these Terms.
4. Content and Intellectual Property
All content provided through TSP — including videos, text, graphics, templates, and other materials — is the intellectual property of Total Success Program and its creator. You may not copy, reproduce, distribute, publish, display, modify, create derivative works from, or exploit any content from the Program without prior written consent.
5. Acceptable Use
You agree not to:
• Share your login credentials with others
• Attempt to download, record, or redistribute any content from the Program
• Use the Program’s content for commercial purposes without written authorization
• Engage in any behavior that disrupts the experience of other members
• Misrepresent your identity or affiliation with the Program
Violation of these terms may result in immediate termination of your membership without refund.
6. Coaching Disclaimer
TSP provides educational and motivational content related to personal and professional development. The information provided is for general guidance only and does not constitute professional advice of any kind, including but not limited to legal, financial, medical, psychological, or therapeutic advice.
No Guaranteed Results. Individual results will vary. We make no guarantees, representations, or warranties that you will achieve any particular outcome, income level, or result from participating in the Program.
Not a Substitute for Professional Services. The content and coaching provided through TSP is not a substitute for professional advice from a licensed attorney, financial advisor, therapist, physician, or other qualified professional. You should consult the appropriate professional for advice specific to your situation.
Personal Responsibility. You acknowledge that you are solely responsible for your own decisions, actions, and results. Participation in the Program is voluntary, and you assume all risk associated with applying any concepts, strategies, or information provided.
7. Limitation of Liability
To the fullest extent permitted by law, Total Success Program, its owner, affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your participation in the Program, whether based on warranty, contract, tort, or any other legal theory — even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of the Program shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Total Success Program, its owner, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Program, your violation of these Terms, or your violation of any rights of a third party.
9. Account Sharing and Simultaneous Use
Your membership allows a limited number of simultaneous connections. Sharing your account credentials with others is prohibited and may result in suspension or termination of your membership without refund.
10. Modifications to Terms and Program
We reserve the right to modify these Terms, the Program content, pricing, or membership structure at any time. Material changes will be communicated to you via the email address associated with your account. Your continued use of the Program after such changes constitutes acceptance of the updated Terms.
11. Dispute Resolution
Any disputes arising from these Terms or your use of the Program shall first be attempted to be resolved through informal negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Any arbitration or legal proceedings shall take place in the state of Michigan.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Total Success Program.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Total Success Program regarding your use of the Program and supersede any prior agreements.
